This Privacy Policy describes how Smeeper collects, uses, and shares information about you when you use our Platform. By using the Platform, you agree to the collection and use of information in accordance with this policy.
Smeeper ("Smeeper," "we," "us," or "our") operates the online classified advertising platform accessible at smeeper.com. For purposes of this Privacy Policy, Smeeper is the data controller with respect to information collected through the Platform.
2.1 Information You Provide. We collect information you provide directly to us, including: account registration information (email address, username, and password); profile information (location, profile photo, and vehicle garage); listing information (vehicle details, photographs, price, and location); messages you send to other users through the Platform; and any other content or information you submit through the Platform.
2.2 Information Collected Automatically. When you access the Platform, we and our service providers automatically collect certain information, including: log data (IP address, browser type, pages visited, time and date of access, and referring URL); device information (device type, operating system, and unique device identifiers); and usage information (features used, actions taken, and session duration).
2.3 Cookies and Similar Technologies. We use cookies, local storage, and similar technologies to operate the Platform, maintain your session, remember your preferences (such as display mode settings), and understand how users interact with the Platform. You may configure your browser to reject cookies, but doing so may limit your ability to use certain features of the Platform.
2.4 Information We Do Not Collect. Smeeper does not process payment card information, Social Security numbers, driver's license numbers, or government-issued identification. All vehicle transactions are conducted directly between buyers and sellers without Smeeper's involvement in payment processing.
We use the information we collect to: operate, maintain, and improve the Platform; create and manage your account; display your listings to other users; facilitate communications between users; enforce our Terms of Use and other policies; respond to your inquiries and provide support; send you service-related notices (such as account verification and policy updates); detect and prevent fraud, abuse, and security incidents; comply with legal obligations; and carry out any other purpose for which you provide the information.
We do not sell your personal information to third parties. We do not use your personal information to serve third-party advertising.
4.1 Information Visible to Other Users. Certain information you provide is publicly visible on the Platform by design, including your username, profile photo, listed vehicles, listing descriptions, listing photographs, listing location (city and state), and profile bio. You should not include in any listing or public profile field any information you do not wish to make publicly available.
4.2 Service Providers. We share information with third-party service providers who assist us in operating the Platform, including database and hosting services (currently Supabase, Inc.), content delivery services, and email delivery providers. These service providers are contractually restricted from using your information for any purpose other than providing services to us.
4.3 Legal Requirements and Safety. We may disclose your information if we believe in good faith that disclosure is necessary to: comply with applicable law, regulation, legal process, or governmental request; enforce our Terms of Use; protect the rights, property, or safety of Smeeper, our users, or the public; or detect, prevent, or address fraud, security, or technical issues.
4.4 Business Transfers. If Smeeper is involved in a merger, acquisition, financing, or sale of all or a portion of its assets, your information may be transferred as part of that transaction. We will provide notice before your information is transferred and becomes subject to a different privacy policy.
4.5 With Your Consent. We may share your information with third parties when you give us express consent to do so.
We do not share your information with any other third parties except as described in this section.
We retain your account information and associated data for as long as your account is active or as needed to provide you services. If you close your account, we will delete or anonymize your personal information within a reasonable period, except where we are required to retain it to comply with legal obligations, resolve disputes, or enforce our agreements. Listing data and public content may be retained in anonymized or aggregated form after account deletion.
We implement reasonable technical and organizational measures to protect your information against unauthorized access, alteration, disclosure, or destruction. However, no method of transmission over the internet or electronic storage is completely secure. We cannot guarantee absolute security, and you use the Platform at your own risk. In the event of a data breach affecting your information, we will notify you as required by applicable law.
The Platform is not directed to, and we do not knowingly collect personal information from, persons under the age of 13. If we become aware that we have collected personal information from a child under 13 without parental consent, we will take steps to delete that information promptly. If you believe a child under 13 has provided us with personal information, please contact us at legal@smeeper.com. Because our Terms of Use require users to be at least 18, we also do not permit accounts for persons between the ages of 13 and 17.
If you are a California resident, the California Consumer Privacy Act (CCPA), as amended by the California Privacy Rights Act (CPRA), provides you with specific rights regarding your personal information.
Categories of Personal Information Collected. We collect identifiers (email address, IP address, username); internet or network activity information (usage data, log data); geolocation data (city and state level); and inferences drawn from this information to create a profile about you.
Purposes. We collect this information for the purposes described in Section 3 above.
Your California Rights. You have the right to: (a) know what personal information we collect, use, disclose, and sell; (b) request deletion of your personal information, subject to certain exceptions; (c) correct inaccurate personal information; (d) opt out of the sale or sharing of personal information (we do not sell or share your personal information as those terms are defined under California law); (e) limit the use of sensitive personal information (we do not collect sensitive personal information as defined by the CPRA); and (f) not be discriminated against for exercising your rights.
Shine the Light. California Civil Code § 1798.83 permits California residents to request information about disclosure of personal information to third parties for direct marketing purposes. We do not disclose personal information to third parties for their direct marketing purposes.
To exercise any of these rights, contact us at legal@smeeper.com. We will respond to verified requests within 45 days as required by law.
Residents of Virginia (VCDPA), Colorado (CPA), Connecticut (CTDPA), Texas (TDPSA), Oregon (OCPA), Montana, Iowa, Indiana, Tennessee, and other states with comprehensive privacy legislation may have rights similar to those described above with respect to access, deletion, correction, and portability of personal information, as well as the right to opt out of certain processing. We extend these rights to residents of all states to the extent required by applicable law. To submit a privacy request, contact us at legal@smeeper.com.
In compliance with CalOPPA, we agree to the following: users may visit the Platform anonymously; we will include a link to this Privacy Policy on our home page and in our footer on all pages; our Privacy Policy link includes the word "Privacy" and is easily findable; users will be notified of any privacy policy changes on this page; and users are able to change their personal information by logging into their account or contacting us.
Some browsers include a "Do Not Track" feature that signals websites you visit that you do not want your online activity tracked. Because there is no universal standard for how to respond to these signals, we do not currently alter our data collection or use practices in response to Do Not Track signals. If a standard is established, we will revisit this policy.
The Platform may contain links to third-party websites or services, including links shared by other users in listing descriptions or messages. We are not responsible for the privacy practices of any third-party site. We encourage you to review the privacy policy of any site you visit.
You may access and update your account information at any time by logging into your account settings. You may request deletion of your account through the account settings page or by contacting us at legal@smeeper.com. Deletion of your account will remove your personal profile and active listings. Some residual information may remain in our backup systems for a limited period consistent with our data retention practices and legal obligations.
We may update this Privacy Policy from time to time. We will provide notice of material changes by updating the effective date above and, where practicable, by sending notice to your registered email address. Your continued use of the Platform after the effective date of any revision constitutes your acceptance of the updated Policy.
